These Terms of Service ("Terms") govern your access to and use of eliminate.live (the "Site"), operated by !Failure Studio, Lahore, Pakistan ("we", "us", "our"). By visiting the Site or submitting an entry, you agree to these Terms, our Content Policy and our Privacy Policy. If you do not agree, do not use the Site.
1. What the Site is
eliminate.live is a public leaderboard of sponsored listings. Businesses and individuals ("Advertisers") submit an entry consisting of a logo, a title, a short message and a website link (a "Listing"). Approved Listings are displayed on the leaderboard in a ranked order.
2. Launch period, ranking and no guaranteed position
- During the current launch period, submitting a Listing is free of charge and no payment is collected.
- Listings are currently ranked by recency of approval: the most recently approved Listing is shown at #1 and every other Listing moves down one position.
- No position is guaranteed. Your rank can change at any moment when a newer Listing is approved. We do not promise that a Listing will hold any rank for any period of time.
- We may change the ranking method, the number of visible positions, the layout or the features of the Site at any time, including introducing paid bidding in the future. Any paid features will be offered under updated terms that you will be asked to accept before paying. Changes will not create any obligation to pay for Listings submitted during the free launch period.
3. No guarantee of traffic or results
We do not guarantee any number of visitors, impressions, clicks, leads, sales, search-engine ranking or any other result from a Listing. All outbound links are marked as sponsored and carry rel="sponsored nofollow", which means they are not intended to pass search-engine ranking value.
Visitor and click numbers shown on the Site are good-faith measurements of unique visitors and unique clicks, provided for information only. They are estimates, may exclude or include some traffic (for example, blocked storage, shared networks, VPNs or bots that evade our filters), may be corrected or recalculated, and are not a promise or warranty of future traffic. We may change how they are measured at any time.
4. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to submit a Listing. If you submit on behalf of a company or other organisation, you confirm that you are authorised to bind it to these Terms, and "you" includes that organisation.
5. Your Listing and your responsibilities
By submitting a Listing, you represent and warrant that:
- you own, or have all necessary rights, licences and permissions to use, the logo, name, trademarks, text and website you submit;
- the Listing is truthful, not misleading, and does not impersonate any person, brand or organisation;
- the Listing and the linked website comply with all applicable laws and with our Content Policy;
- the linked website does not contain malware, phishing, or deceptive or unlawful content;
- the information you provide to us, including your email address, is accurate.
You are solely responsible for your Listing, the website it links to, and any products, services or claims it promotes. We do not verify the claims made by Advertisers and are not a party to any transaction between you and a visitor.
6. Licence you grant us
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, format, display and publicly show your Listing on the Site and in promotional material about the Site (for example, screenshots of the leaderboard shared on social media), for as long as the Listing is shown and for a reasonable period after, including in archived or cached copies. You keep ownership of your content.
7. Review, moderation and removal
- Every Listing may be reviewed before it is published. We may approve or reject any Listing at our sole discretion, with or without giving a reason.
- We may hide, remove or refuse to republish any Listing at any time, including after approval, if we believe it breaches these Terms or the Content Policy, receives a credible complaint, creates legal risk, or for any other reasonable reason.
- Approved Listings cannot be edited. To change a Listing, submit a new one.
- We may limit how often a person, email address or network can submit Listings, and may block submissions we believe are automated, abusive or fraudulent.
8. Prohibited use of the Site
You must not:
- use bots, scripts or automated means to submit Listings or to scrape the Site in a way that burdens it;
- attempt to bypass rate limits, bot checks or moderation;
- interfere with, probe or attack the security or operation of the Site;
- use the Site for any unlawful purpose, or to harass, defame or harm any person.
9. Intellectual property complaints
If you believe a Listing infringes your trademark, copyright or other rights, email legal@eliminate.live with: your contact details, identification of the protected work or mark, the Listing concerned, a statement that you have a good-faith belief the use is not authorised, and a statement that the information in your notice is accurate and that you are the rights owner or authorised to act for them. We will review the notice and may remove the Listing. We may share your notice with the Advertiser concerned.
10. Third-party websites
Listings link to websites operated by third parties. We do not control and are not responsible for those websites, their content, products, services or privacy practices. Visiting them is at your own risk. Display of a Listing is not an endorsement, recommendation or verification by us.
11. Disclaimer of warranties
The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability and accuracy. We do not warrant that the Site will be uninterrupted, secure or error-free, or that any Listing will be displayed at any particular time or position.
12. Limitation of liability
To the fullest extent permitted by law, we and our owners, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, arising out of or related to the Site or any Listing. Our total aggregate liability for any claim arising out of or related to the Site or these Terms is limited to the greater of (a) the amount you paid us in the twelve months before the claim, and (b) USD 10. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your Listing, the website it links to, your breach of these Terms, or your violation of any law or third-party right.
14. Cooperation with authorities
We may preserve and disclose information about a Listing or a submitter where we believe in good faith that it is required by law, by a valid request from a competent authority, or necessary to protect the rights, property or safety of us, our users or the public.
15. Suspension and termination
We may suspend or stop operating the Site, in whole or in part, at any time. We may block any person from submitting Listings. Sections 5, 6 (for archived copies), 9 to 13, 16 and 17 survive termination.
16. Governing law and disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the competent courts at Lahore, Pakistan. Before starting any formal proceedings, you agree to first contact us at legal@eliminate.live and try in good faith to resolve the dispute informally for at least 30 days.
17. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Site after changes take effect means you accept the updated Terms. Material changes that affect paid features will not apply to payments made before the change.
18. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a sale or reorganisation of the Site. These Terms, together with the Content Policy and Privacy Policy, are the entire agreement between you and us about the Site.
